1 · Us

tooly-kit.com ("Tooly Kit", "we") is operated by FLOFUM, S.L., registered office Calle Parcerisa 13, Local 1, 08014 Barcelona, Spain, CIF B75621250. Contact: support@tooly-kit.com.

"Tooly Kit" is a trading name only. Every contract formed here is with the company named above.

2 · Agreeing to this

Using the site or sending an order request means these terms apply. If they do not suit you, please do not order. Keep a copy — we recommend saving or printing this page when you place a request.

None of this removes or limits any right you hold under mandatory consumer law where you live.

3 · Who can buy

You must be 18 or over and legally able to enter contracts. Ordering confirms that you are. We sell to consumers and to businesses; where a clause applies only to consumers it says so.

4 · Descriptions and photographs

We describe goods as accurately as we can — specification, dimensions, what is in the box. Even so:

• Photographs illustrate. Screens render colour differently and packaging design changes.
• Manufacturers revise specifications without telling retailers.
• Small differences between picture and product do not make an item non-conforming.

Where a delivered item differs in a way that actually matters, the Returns policy applies in full.

5 · Prices

• Shown in euro (€) unless stated otherwise, inclusive of VAT where VAT applies.
• Carriage and any cash-handling charge are separate and disclosed in full during confirmation, before you commit.
• The total the courier collects is the total we confirmed. Nothing is added later.
• We may change prices whenever we like, but never for an order already confirmed.

Where a price is displayed wrongly through obvious error, we are not obliged to supply at it. We will contact you, explain, and let you choose between the corrected price and cancelling free of charge.

6 · When a contract exists

1. Your request is an offer to buy. It binds nobody and takes no payment.
2. We may contact you to check details and stock.
3. A contract comes into being only when we confirm the order and tell you it has been dispatched.

We may decline a request — no stock, address outside our service area, contact details we cannot verify, or an obvious pricing error. Declining costs you nothing.

7 · Payment: cash on delivery, and nothing else

• Paid in cash, in the delivery country's currency, when the parcel changes hands.
• Ownership passes to you on payment in full.
• Risk passes when you, or somebody you nominate, physically takes the goods.
• We will never request card details, banking credentials or advance payment. Any such approach is fraudulent — report it to support@tooly-kit.com.

8 · Delivery

Timings, charges, failed attempts and damage are governed by the Delivery policy, which forms part of these terms. Transit figures are estimates, not guaranteed dates.

Where we have failed to deliver within 30 days of confirmation and you have given us a further reasonable period, you may cancel.

9 · Cancelling and returning

Consumers get a statutory 14 days to withdraw; we extend that to 30 days. Procedure, exclusions and refund timing are in the Returns policy, which forms part of these terms.

10 · Guarantee of conformity

Goods sold to consumers carry the two-year legal guarantee under Directive 2019/771. How to claim is in section 7 of the Returns policy.

11 · Using this website properly

You agree not to:

• Use the site unlawfully or fraudulently
• Place requests you have no intention of accepting or paying for
• Attempt unauthorised access to the site, its server or connected systems
• Introduce malicious code, or scrape, overload or disrupt the site with automated tools
• Copy, reproduce or resell any part of the site without written permission

We may refuse or withdraw service from anyone in breach.

12 · Intellectual property

Text, layout, graphics, logos and their arrangement on this site belong to FLOFUM, S.L. or are licensed to us, and are protected by copyright and trade mark law. Manufacturer names and marks remain their owners' property; their appearance here implies no endorsement of us by them and no affiliation with them.

13 · Availability

We aim to keep the site up but guarantee nothing. It may be suspended, withdrawn or restricted for maintenance or business reasons, with notice where that is reasonably possible.

14 · Liability

Nothing here excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded — including consumers' statutory rights and our product liability obligations.

Subject to that, we are not liable for:

• Lost profit, lost business, business interruption or lost opportunity
• Harm caused by using a product against the manufacturer's instructions or applicable safety rules
• Delay or failure from events outside our reasonable control — severe weather, industrial action, carrier failure, restrictions imposed by authorities

Where we are liable, liability is capped at the price paid for the goods in question.

15 · Working safely

Much of our range is powered tooling or electrical equipment. Read and follow the manufacturer's instructions and safety warnings, use suitable protective equipment, and keep such items away from children. We are not liable for injury or damage arising from misuse or from ignoring those instructions.

16 · Your data

Handled under our Privacy Policy and Cookie Policy.

17 · Changes

These terms may be amended. The version binding you is the one published here when your request is made; changes are never applied backwards to confirmed orders. The date at the top shows when the current version took effect.

18 · Law and jurisdiction

Governed by the law of Spain. Consumers resident elsewhere in the EU keep the protection of the mandatory consumer law of their own country and may bring proceedings in its courts.

19 · Disputes

Write to support@tooly-kit.com first — nearly everything is resolved there. Failing that, EU consumers may approach their national consumer protection authority or a local alternative dispute resolution body.

20 · Severability and whole agreement

If any provision proves unlawful or unenforceable, the rest stands. These terms together with the Delivery, Returns, Privacy and Cookie policies form the entire agreement between you and FLOFUM, S.L. in respect of your purchase.
